TERMS OF SERVICE

Effective 2026-06-03. The conditions under which MediCaine sells compound numbing preparations to licensed providers.

1. Eligibility

MediCaine is sold exclusively to licensed healthcare and aesthetic providers with an active National Provider Identifier (NPI) and valid state license authorizing them to receive prescription-strength compounded topical anesthetics. By placing an order, you represent that you meet these criteria.

2. License verification

All orders are subject to NPI Registry verification through the CMS API. We may refuse, hold, or cancel any order that fails verification or where we have reason to question the eligibility of the ordering provider. See our Compliance page for verification details.

3. Order acceptance

Placement of an order through the configurator constitutes an offer. We accept your offer when we begin compounding the preparation. We reserve the right to decline any order in our discretion, including for failed verification, shipping restrictions, capacity, or for any reason consistent with applicable law.

4. Pricing and payment

Prices are shown in US dollars and are subject to change without notice prior to order acceptance. Payment is processed through our PCI-DSS compliant payment processor. Failed or chargeback payments invalidate the order.

5. Auto-reorder

Auto-reorder, when enabled, queues subsequent orders at the interval you selected. You may modify or cancel auto-reorder from your account or by contacting us. We will send a reminder before each auto-reorder batch is queued.

6. Compounding and beyond-use dating

Preparations are compounded fresh per order under USP 795 standards and labeled with a beyond-use date determined by formulation and storage requirements. Providers are responsible for storing preparations as labeled and disposing of them per their state board requirements after the beyond-use date.

7. Returns and refunds

Compounded medications are dispensed for a specific provider and cannot be returned to inventory under state board of pharmacy rules. If your order arrives damaged, incorrect, or in a way inconsistent with your verified order details, contact us within 7 days of delivery and we will work to make it right — replacement compound, credit, or refund as appropriate.

8. Provider responsibility

Providers are responsible for clinical use of MediCaine — patient screening, application protocol, dose calculation, removal before procedures that breach the skin, and adverse event documentation. Application guidance on this site is informational and does not substitute for provider clinical judgment.

9. Limitation of liability

To the maximum extent permitted by law, MediCaine's liability for any claim arising out of the sale or use of our products is limited to the purchase price of the product giving rise to the claim. We are not liable for indirect, consequential, special, or punitive damages. This limitation does not apply to liability that cannot be limited under applicable law.

10. Intellectual property

All content on this site — text, graphics, formulations, schema, software — is owned by MediCaine or our licensors and protected by US and international intellectual property law. The MediCaine name, logo, and bear mascot are trademarks of MediCaine.

11. Governing law

These terms are governed by the laws of the State of California, without regard to conflict of laws principles. Disputes will be resolved in the state or federal courts located in Los Angeles County, California.

12. Changes

Material changes to these terms will be reflected here with a revised effective date. Continued use of the site after changes constitutes acceptance.
